1. Scope of Application

The following terms and conditions apply to all orders placed via our online shop.

2. Contracting Party, Conclusion of Contract

The purchase contract is concluded with mitavine GmbH

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping basket without obligation and correct your entries at any time before sending your binding order by using the correction aids provided and explained for this purpose in the order process. The contract is concluded when you accept the offer for the goods contained in the shopping basket by clicking on the order button. Immediately after sending the order, you will receive another confirmation by e-mail.

3. Contract Language, Contract Text Storage
The language available for the conclusion of the contract is German.

We do not store the text of the contract.

4. Delivery Conditions

Shipping costs are added to the stated product prices. You can find out more about the shipping costs in the offers.

We only deliver by mail order. Unfortunately, it is not possible to collect the goods yourself.

5. Payment

The following payment methods are generally available in our shop:

Advance payment
If you choose payment in advance, we will provide you with our bank details in a separate e-mail and deliver the goods after receipt of payment.

Cash-on-delivery
You pay the purchase price directly to the delivery agent. There are no further costs for this.

Credit card
When you place your order, you also send us your credit card details.
After your legitimation as a legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after the order. The payment transaction is automatically carried out by the credit card company and your card is charged.

PayPal
During the ordering process you will be redirected to the website of the online provider PayPal. In order to pay the invoice amount via PayPal, you must be registered there or register first, legitimise yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction.
The payment transaction will be carried out automatically by PayPal immediately afterwards. You will receive further instructions during the ordering process.
 

PayPal Plus
As part of the PayPal Plus payment service, we offer you various payment methods as PayPal Services. You will be redirected to the website of the online provider PayPal. There you can enter your payment details, confirm the use of your data by PayPal and the payment instruction to PayPal.

If you have chosen the PayPal payment method, you must be registered there or register first and legitimise yourself with your access data in order to pay the invoice amount. The payment transaction is carried out automatically by PayPal immediately after confirmation of the payment instruction. You will receive further instructions during the ordering process.

If you have chosen the credit card payment method, you do not have to be registered with PayPal to pay the invoice amount. The payment transaction will be carried out by your credit card company at PayPal's request immediately after confirmation of the payment instruction and after your legitimation as a legitimate cardholder, and your card will be charged. You will receive further instructions during the ordering process.
 

Instant
After placing the order, you will be redirected to the website of the online provider Sofort GmbH. In order to be able to pay the invoice amount via Sofort, you must have an online banking account with PIN/TAN procedure activated for participation in Sofort, identify yourself accordingly and confirm the payment instruction to us. You will receive further instructions during the ordering process. The payment transaction will be carried out immediately afterwards by Sofort and your account will be debited.

Amazon Pay
In the order process, you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. In order to complete the order process and pay the invoice amount via Amazon, you must be registered there or register first and legitimise yourself with your access data. There you can select the delivery address and payment method stored at Amazon, confirm the use of your data by Amazon and the payment instruction to us. You will then be redirected back to our online shop where you can complete the ordering process.
Immediately after placing the order, we request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon. You will receive further instructions during the ordering process.

6. Retention of Title

The goods remain our property until full payment.

7. Transport Damages

If goods are delivered with obvious transport damage, please complain about such faults to the delivery agent as soon as possible and contact us immediately. Failure to make a complaint or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, they help us to be able to assert our own claims against the carrier or the transport insurance.

8 Warranty and Guarantees

The statutory liability for defects applies. Information on any additional guarantees that may apply and their exact conditions can be found with the product and on special information pages in the online shop.

9. Dispute Resolution
The European Commission provides a platform for online dispute resolution (ODR), which you can find here https://ec.europa.eu/consumers/odr/. Consumers have the possibility to use this platform for the settlement of their disputes.
In order to settle disputes arising from a contractual relationship with a consumer or as to whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The competent body is the General Consumer Arbitration Board of the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de. We will participate in a dispute resolution procedure before this body.

10. Customer Review

a) Interested parties (also customers) can report their experiences with our products on the website in the area provided for this purpose and submit opinions or evaluations on this (customer reviews) as well as view corresponding customer reviews of other interested parties. The interested party has no right to submit or publish a customer review. mitavine GmbH distances itself from published customer reviews, does not adopt them as its own and accepts no responsibility for them.

b) With the submission of a customer review, the interested party grants mitavine GmbH the simple, gratuitous, revocable, as well as spatially and temporally unrestricted right of use (including the right of editing, as far as the editing and transformation is carried out while maintaining the intellectual character of the work). The interested party waives the right to be named as author, but may be named as author.

c) The respective interested party indemnifies mitavine GmbH from any claims asserted by third parties against mitavine GmbH due to the publication of his customer review. The interested party has to bear the costs of the necessary legal defence (especially court and lawyer's fees) of mitavine GmbH. This does not apply if the interested party is not responsible for the infringement.
